Early morning call leads to Kimball man's sixth DUI

Cliff (Skip) Coyle was arrested early in the morning of Sunday, Oct. 7 following a trespassing call to Kimball Dispatch.

According to an arrest affidavit at approximately 1:14 a.m. on Oct. 7, 2018 Officer Michael Winget of the Kimball Police Department responded to 3270 County Road 43 with units in reference to a vehicle trespassing on the property. The vehicle was described as a silver or gray four-door sedan with Kimball County plates.

Witnesses saw a male operating the vehicle, it appeared that the vehicle parked for a short period of time, then the driver exited the vehicle, to enter a garage on the property then retreating back to the vehicle and left the property.

The owners of the property had game cameras on the property previously. The pictures on the camera revealed that there was an early 2010’s Nissan four-door sedan was photographed driving into the residence and then was seen leaving a short time later.

The affidavit states that at approximately 3:06 a.m. that same morning, shortly after completing his shift for the KPD, Winget was driving eastbound on E. 3rd Street, still in the KPD Emergency vehicle and KPD issued uniform. Winget then passed a silver Nissan Altima sedan bearing the same license plate of the vehicle in the photos of the property above, the vehicle was driven my a male and there was also a female passenger in the vehicle. The vehicle was traveling westbound on E. 3rd Street. According to the affidavit Winget then turned his patrol vehicle around, activated the emergency lights, and conducted a traffic stop in the Main Street Market grocery store parking lot.

Winget made contact with the driver and passenger, identifying himself and the reason for the traffic stop. Winget asked both of the occupants for their drivers licenses, the driver stated he didn’t have a license. Winget then asked if he didn’t have one or if it had been suspended, the driver did not reply.

The driver then identified himself as Cliff Coyle 36-years-old. The female passenger advised Winget that she was the owner of the vehicle, then confirmed as Kimberly Scogin. At this Coyle was asked to step out of the vehicle.

Coyle stepped out of the vehicle and spoke with Winget. Winget advised Coyle that he wanted to ask him questions about what had happened earlier at 3270 CR 43. Coyle stated that he wanted a lawyer present during questioning.

Winget requested Scogin to get out of the vehicle as well. Scogin was asked what she and Coyle had been doing, she stated that she had been drinking alcohol and asked Coyle for a ride. Scogin then told Winget that Coyle agreed and the two began to drive to E. 6th Street and County Road 43.

Winget states in the arrest affidavit that it is important to note that the owner of the property who called about the trespassing car and potential theft is Coyle’s mother. Winget then asked Scogin if Coyle stopped at his mom’s house she stated yes, that he did. When asked if Coyle told her what he was doing there, she stated that he said he needed to get something out of the large garage. Scogin stated that she didn’t know if Coyle had been drinking, when asked.

At this time Deputy Jason Hottell of the Kimball County Sheriff’s Office responded to Winget’s location and proceeded to attempt to speak with Coyle. When Coyle was asked if he had been drinking, he stated that yes, he had been drinking and that he had three beers approximately three hours to the contact with the officer.

According to the affidavit, Coyle’s speech was slurred, his eyes were bloodshot and watery, there was the odor of an alcoholic beverage coming form the vehicle when Winget initially made contact with the occupants, and Coyle had the odor of an alcoholic beverage coming from his person when Winget spoke with him.

At this time, Coyle was asked to do a field sobriety test, which he refused, Coyle was then asked to submit to a preliminary breath test which he also refused, Coyle was then placed under arrest for driving under suspension, refusal to submit to chemical test and driving under the influence (DUI).

Before Coyle was placed in Winget’s KPD vehicle, he asked if Winget would call his mother and have her go over to Coyle’s house and pick up Coyle’s six-year-old son who was left at the house by himself while Coyle and Scogin were out driving around. Winget asked where Coyle’s son was Coyle stated that he was sleeping on the couch. Winget complied and called his mother, his mother stated that she would go and pick him up immediately.

While walking to Winget’s patrol vehicle, Winget stated that Coyle seemed uneasy on his feet as he stumbled.

After Coyle was placed in Winget’s vehicle, Coyle was asked to submit to the Datamaster or a blood draw. Coyle told Deputy Hottell and Officer Winget that he was going to refuse all forms of testing related to a DUI. Coyle was then transported to the Kimball County Sheriff’s Office Jail.

According to the affidavit a search warrant was obtained for a blood draw of Coyle’s blood as he refused to submit to any test. The search warrant was conducted at the Kimball Health Services Emergency Room at approximately 5:58 a.m. Two vials of Coyle’s blood were obtained and were sent to the Nebraska State Laboratory for further testing. Coyle was then transported back to the Kimball County Jail where he was booked and charged with, a parole violation, a sixth offense DUI, refusal to submit to chemical test, driving under suspension and child abuse (neglect).
